“What areas of law do you practice?”

“What is the difference between a ‘retainer’ and having an attorney ‘on retainer’?”

A “retainer” is a sum of money that a client pays to the Attorney as a deposit when he/she agrees to hire (retain) the Attorney’s services.  The retainer amount varies depending on the type of case: a non-litigation retainer may start at $650.00, whereas a litigation retainer may start at $2,500.00.   Fees and costs are deducted from such deposit at the time of each billing statement and the retainer deposit is then replenished by the Client.

Having an attorney “on retainer” is where the Client and the Attorney agree to a monthly fee to be paid to the attorney for on-going services.  For example, a Company that does not have a human resources department or a larger Company can pay a flat rate per month for a certain number of hours of legal services each month, at a negotiated rate, which is lower than our regular hourly rate. 

A Business can maintain a ‘retainer’ in our Attorney Trust Account, which allows the Client to maintain an open general business file, and call the Attorney regarding day-to-day legal questions, as they arise, without having to open a new file for a question or small matter.  The Client is billed only for the time spent on the phone call and related requested services. The Client may close its file at any time, whereby the retainer balance is refunded to the Client.

 


“What is ‘preventative law’”

Have you heard the saying: “An ounce of prevention is worth a pound of cure.” by Benjamin Franklin?

The Fritz Law Offices places a major emphasis on “preventative law” to advise clients how to implement measures in their business that will minimize the cost, complexity, and risk or need of future litigation. Such costs include not just attorney’s fees, but the client’s own time and business resources.  A Client’s investment in preventative measures to secure timely legal advice before acting, signing, or communicating at key times in operating a business or in ensuring clear and efficient agreements (both internally and externally) generally avoids ten times or more in legal costs and the Clients time that could otherwise be devoted to profitable business operations. 

Preventative law also involves Client education of laws and regulations applicable to their industry.  An Attorney that is on retainer also learns the nature and economics of the Client’s business.  This allows for evermore effective decision making at far less cost and in far less time in the future.  In short, preventative law facilitates far greater value for every dollar invested in legal services, which ultimately is the goal of the Fritz Law Offices in providing each of our Client’s with premium legal services.
